1. GENERAL
1.1 The contract terms (Terms and Conditions) listed below shall apply for all contracts concluded via internet presence of our company “Top Condition Finland” under the domain www.bikinihiit.com with the customer (hereinafter CUSTOMER).
1.2 Top Condition Finland Ltd does not accept any deviating terms and conditions of the CUSTOMER unless we agree to these explicitly and in writing.
1.3 The terms and conditions listed below are directed only at CUSTOMERS who are users, which means people who conclude legal transactions for a purpose which is attributed to personal and non-commercial use only.
2. SUBJECT TO THE CONTRACT
2.1 The CUSTOMER has the possibility to access the Bikini HIIT Challenge online program via the internet page www.bikinihiit.com.
2.2 English is the contractual language.
3. RIGHTS OF REVOCATION
3.1 Top Condition Finland Ltd offers the CUSTOMER the possibility of a 14-day money back guarantee if a detailed reason is given. The 14-day period commences upon payment. Should the CUSTOMER not be satisfied with our services, they can ask for their right of revocation. To do so, an e-mail to info@huippukunto.fi has to be sent in which it has to be made explicitly clear, that the CUSTOMER wants their money back. We will check such e-mails for correctness of date and – should the complaint be brought forth in the period mentioned above. We will transfer the full purchase price immediately onto the CUSTOMER'S bank account.
Should the payment have been undertaken via PayPal, the full purchase price will be transferred back onto the CUSTOMER'S account.
4. PRICES
4.1 The confirmed prices of the day of the registration shall apply as they are displayed on the www.bikinihiit.com
4.2 All prices are to be stated in US Dollars.
5. TERMS OF PAYMENT
5.1 Top Condition Finland Ltd accepts only the methods of payment stated on the web portal during the order process. The CUSTOMER independently chooses the preferred way of paying among the offered payment methods.
5.2 During the payment process the CUSTOMER can choose between the following payment options:
5.2.1 Provided that a service against payment via credit card takes place, by submitting their credit card data, the CUSTOMER
grants authorization to charge the respective credit card company with the full price including possible shipping and handling fees on the due date. In this case, the charge is prompted with the order confirmation.
5.2.2 Provided that a payment takes place via PayPal, the CUSTOMER has to own a PayPal account and has to prove their identity by submitting their access data. Thereafter the CUSTOMER has to undergo the PayPal payment process and confirm the payment to Fow Isnald Ltd.
6. LIABILITY
6.1 The CUSTOMER's claims to damages or compensation of frustrated expenditures against Top Condition Finland Ltd, are directed – without regard to the legal nature of the asserted claim – according to these terms.
6.2 Our liability – regardless of the the legal basis of the CUSTOMER'S claims – shall be excluded unless the damage arose due to intent or gross negligence on our part, by our employees, legal representatives, or vicarious agents. Provided our liability is excluded or limited, the same goes for the personal liability of our employees, legal representatives, or vicarious agents.
6.3 We accept liability in accordance with the statutory law for of damage resulting from injury to life, limb or health, due to intentional gross negligence or negligence of duties arising from the contractual relationship on our part, by our legal representatives, employees or vicarious agents.
6.4 Should we at least negligently breach material contractual duties, which means duties that are of particular importance to the achievement of the purpose of the contract (material contractual duty or cardinal duty), the amount of our liability will be limited to the typical foreseeable damage. A material contractual or cardinal duty in the aforementioned sense is such a duty whose fulfillment makes the proper execution possible to begin with and in whose compliance the CUSTOMER regularly trusts and may trust.
6.5 The CUSTOMER shall independently insure themselves against accidents and injuries which may occur due to the training program.
7. DATA STORAGE AND DATA PROTECTION
7.1 The CUSTOMER acknowledges and consents to Top Condition Finland Ltd storing the CUSTOMER'S personal data necessary to processing an order. The CUSTOMER explicitly consents to collecting, processing and using their personal data. Of course, stored personal data will be treated confidentially.
7.2 The CUSTOMER has the right to revoke their consent with future effect. In such a case, we are obliged to erase or block personal data in accordance with the applying data protection regulations. In case of a canceled registration processes, the erasure of personal data occurs after cancellation of the registration process.
8. CONTRACT DURATION
8.1 Bikini HIIT Challenge
The duration of the contract is to 90 days. Within these 90 days, the CUSTOMER is granted the right to log in to the training platform.
9. IMAGE RIGHTS
During the contract duration, the CUSTOMER has the possibility to provide us with a current picture of themselves. The providing of the image is optional and serves solely the purpose of an optimum analysis of the CUSTOMER'S current condition.
Should the CUSTOMER decide to provide us with a picture via the domain www.bikinihiit.com, the CUSTOMER is obliged to make sure that they have the full copyright on it.
Should the CUSTOMER provide a picture that they do not have the copyright on, we are excluding any liability.
From the moment of uploading the image at the domain www.bikinihiit.com, the CUSTOMER permits us to use the image also for advertising purposes (e.g. uploading it on social media).
10. RISKS OF PRODUCT USE
This website’s content is not a substitute for direct, personal, professional medical care and diagnosis.
